Terms of Service
The terms on which you use The Fence and order your personalised pet products.
Who we are and accepting these terms
The Fence (thefence.uk) is operated by [FILL IN: registered company / legal entity name], company number [FILL IN: company number (Companies House)], registered office [FILL IN: registered office address]. The Fence is a trading name of [FILL IN: registered company name]. You can contact us at hello@thefence.uk.
By using this site or placing an order, you accept these Terms. Please read them carefully. This version is effective from [FILL IN: effective / last-updated date for this version]. [FILL IN: VAT number, if VAT-registered — otherwise omit].
How your product is made
We create a personalised pet portrait generated by AI from the photo you upload, in the style you choose, and then apply it to the product(s) you select — such as canvas, framed and poster prints, mugs, blankets, cushions, apparel, phone cases, and other items.
To be clear and accurate about how this works: your portrait is created in our studio using AI from your photo, and our team reviews every portrait and always sends you a digital proof to approve before anything is printed, with revisions until you are happy. It is not hand-painted or made by human artists; it is AI-assisted creation with a human proof-and-approval step.
Orders and pricing
Prices are shown in pounds sterling (GBP, £) and are the total amount payable for the goods. Prices include VAT where applicable. [FILL IN: add your VAT registration number if VAT-registered, or state that the business is not currently VAT-registered].
Your order is an offer to buy. A contract is formed only when we confirm or accept your order. [FILL IN: confirm acceptance mechanism — e.g. order-confirmation email vs. dispatch].
If an order is placed at an obviously incorrect price due to a typo or pricing error, we may cancel and refund it; we will contact you first.
Free standard UK shipping applies on orders over £75; below that, a standard shipping fee applies and is shown at checkout. [FILL IN: standard shipping rates and any expedited options]. [FILL IN: delivery destinations/countries served].
Fulfilment is handled by our print-on-demand partners, Gelato and Printify, who print and ship your order. Your digital proof is typically ready within 24 hours, and printing and shipping follow once you approve it. [FILL IN: stated dispatch/delivery timeframes].
Your responsibilities and acceptable use of uploads
You are responsible for the accuracy and quality of the photo and personalisation details you provide, including the spelling of any names, your chosen style and options, and the clarity of the photo. The proof stage is there to help you check these before printing.
By uploading a photo you confirm that you:
- own the photo or have all the rights needed to use it;
- are not uploading images containing other identifiable people without their consent;
- are not uploading anything unlawful, infringing, offensive, or that violates anyone else's rights.
AI-generated artwork and intellectual property
Your finished portrait is created in our studio using AI from your photo. We grant you a licence to use the finished artwork for personal, non-commercial use. [FILL IN: confirm exact licence scope — personal use only vs. any commercial allowance].
All site content, branding, designs, templates, and our underlying intellectual property remain reserved to us or our licensors. [FILL IN: confirm position on commercial resale of the artwork and on us reusing anonymised/sample outputs for portfolio/marketing — only if true].
Proof and approval
Every order includes a digital proof that you must approve before we print, and we offer revisions until you are happy. Nothing is printed until you give your approval. [FILL IN: any stated revision limit or response window before we proceed — only if a real policy exists].
Cancellation — Consumer Contracts Regulations 2013
Because every item is personalised and made to your specification, the standard 14-day change-of-mind cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to these personalised goods — this is the made-to-order/personalised exemption.
Before you approve your proof, you can still amend or cancel your order through the proof stage. [FILL IN: confirm pre-approval cancellation/amendment window and whether any AI-generation work already done is chargeable].
Your statutory rights are preserved
The personalisation exemption above does not affect your statutory rights under the Consumer Rights Act 2015. Goods must be of satisfactory quality, fit for purpose, and as described. Faulty, damaged, or not-as-described items are covered — please see our Returns & Refunds page.
Our liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, for fraud, and your statutory consumer rights, all of which remain intact. [FILL IN: confirm the exact liability cap/scope wording the business wants, within legal limits].
Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales. If you are a consumer, you keep the protections of your home jurisdiction where applicable.
Contact
For any question about these Terms, email hello@thefence.uk. [FILL IN: postal address for formal notices].
